Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the JourneyGen platform, website, and related services (the “Service”) provided by JourneyGen (“JourneyGen”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if you use the Service for a travel agency or other organization, on behalf of that organization (“you” or the “Agency”). If you do not have authority to bind the organization, or you do not agree to these Terms, do not use the Service.
1. The Service
JourneyGen is a software platform that helps travel agencies build custom tour packages — including hotels, transport, attractions, itineraries, and pricing — and generate client-ready documents, with the assistance of AI features. We may add, change, or remove features of the Service over time.
2. Eligibility and Accounts
- The Service is intended for business use by travel agencies and their staff. You must be at least 18 years old to create an account.
- You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account and your organization, including actions taken by team members you invite.
- Notify us promptly at [email protected] if you suspect unauthorized use of your account.
3. Your Data
You retain all rights to the data you and your team enter into the Service, including client records, catalogs, rates, and packages (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service.
You are responsible for your Customer Data, including ensuring that you have the necessary rights and consents to enter personal information about your clients and travelers into the Service, and that doing so complies with the laws that apply to you. Our handling of personal information is described in our Privacy Policy.
4. AI-Generated Content
The Service uses artificial intelligence to help build packages, allocate nights, select transport, and draft itineraries. AI-generated output is a starting point, not a guarantee:
- AI output may contain errors or outdated information. You must review and verify all packages before sending them to clients — including prices, availability, schedules, ferry and flight times, and visa or entry requirements.
- You are solely responsible for the final itineraries, quotes, and documents you deliver to your clients, and for the travel services you sell.
- JourneyGen is a software tool. We are not a travel agency, tour operator, or party to any booking between you and your clients or suppliers.
5. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Attempt to access data belonging to another organization, or probe, scan, or test the vulnerability of the Service without our written permission.
- Reverse engineer, copy, resell, or sublicense the Service, or use it to build a competing product.
- Upload malicious code, interfere with the Service’s operation, or place unreasonable load on our infrastructure.
- Use the AI features to generate unlawful, misleading, or harmful content.
6. Third-Party Services
The Service relies on third-party providers, including cloud hosting and database services and AI model providers. We are not responsible for third-party services we do not control, but we choose providers with appropriate commitments and pass through their relevant restrictions where required.
7. Fees
Access to the Service may require a paid subscription. Fees, billing periods, and included features are set out in your plan or order form. Unless stated otherwise, fees are non-refundable and exclusive of taxes. We may change pricing with notice before your next billing period.
8. Intellectual Property
JourneyGen and its licensors own all rights in the Service, including its software, design, built-in catalogs, and branding. These Terms do not grant you any rights in the Service other than the limited right to use it in accordance with these Terms. Feedback you provide about the Service may be used by us without obligation.
9. Term and Termination
- You may stop using the Service or close your organization’s account at any time.
- We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your use poses a security risk to the Service or other customers. Where practical, we will give you notice first.
- Upon termination, your right to use the Service ends. We will handle your Customer Data as described in our Privacy Policy; you may export your packages and documents before closure.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
11. Limitation of Liability
To the maximum extent permitted by law: (a) neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim (or USD 100 if you have not paid us). Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnification
You will indemnify and hold harmless JourneyGen from claims arising out of your Customer Data, your use of the Service in violation of these Terms, or the travel services you provide to your clients.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of [Jurisdiction], without regard to its conflict-of-laws rules, and the courts of [Jurisdiction] will have exclusive jurisdiction over disputes arising from these Terms, except where the law of your country requires otherwise.
